THE ALABAMA PECAN FESTIVAL BOARD RESERVES THE RIGHT TO ACCEPT OR REJECT ANY APPLICATION AND THEIR DECISION IS FINAL.

If accepted into this festival you must provide proof of $1,000,000 liability insurance with The Alabama Pecan Festival named as additional insured.

The Alabama Pecan Festival Board reserve the right to accept or reject any application or any part there of and their decision is final.

I agree to sell only the items listed. If accepted into the festival, NO item can be added to this list without the agreement of the Alabama Pecan Festival Coordinator. Some items may not be sold due to product balance during the festival. Vendors will be informed of such incidents.

AGREEMENT TO HOLD HARMLESS AND INDEMNIFY

“VENDOR”, who declared that in consideration of being allowed to participate in that certain festival to be held in Mobile, Alabama, commonly known as “Alabama Pecan Festival” from the 31st day of October to the 2nd day of November, 2008, VENDOR does hereby agree to defend, Hold harmless and indemnify officers, representatives and employees, from and against each and every claim, demand, or cause of action and any liability, cost and expense (including attorney’s fees) for damages or loss of connection therewith, which may be made or asserted by VENDOR, its employees or agents, or any third parties, on account of personal /bodily injury, including wrongful death, or property damages caused by, arising out of, or in any way incidental to or in connection with the participation of VENDOR in said festival, including the sale by VENDOR of any food/beverages, or the condition, maintenance or upkeep or any portable or stationary sale booth/trailer, whether or not said liability shall rise out of negligence, strict liability or a condition of any premises used or occupied by VENDOR.

VENDOR further agrees to provide and maintain, throughout its participation in the ALABAMA PECAN FESTIVAL, liability coverage in an amount not less than ($1,000,000) per occurrence, said liability, coverage for contractual liability assumed by Vendor under the terms of this agreement.
